Terms of Service
Last updated: 26 September 2026
1. Who we are
First To One is an Australian sole trader business operating under ABN 38 700 547 034.
Support: one@firsttoone.com. Business mailing address: Suite 2577, 85 Burt St, Boulder WA 6432, Australia.
2. Your agreement and account
By creating an account, checking the Terms/Privacy acceptance box, or continuing to use First To One, you agree to these Terms and any rules shown for a feature you use. You must provide accurate information, keep your account secure and use the service lawfully.
You must not use bots, automated claiming, multiple accounts to evade limits, collusion, deceptive activity, unauthorised access or other methods intended to manipulate allocations, rankings, trades, auctions or other service activity. We may restrict an account while investigating suspected misuse, security issues or rule breaches.
3. Games and number allocation
Each game uses a shared pool of unique numbers from 1 to 8.3 billion. Numbers allocated to you are assigned to your account for use within First To One.
Finding Number 1 locks that game's winner and final competitive standings and starts a 48-hour final window. During that final window, verified users may continue to claim numbers that remain unclaimed and current-game number-for-number trading may continue. When the 48 hours ends, all numbers that were never claimed or validly awarded through an enabled exact-number auction are retired permanently, the game is archived, and the next game begins with a fresh 1–8.3 billion pool.
There is no operator-funded cash or material prize for finding Number 1. Number 1 provides in-service status, recognition and the game-ending result only unless we clearly publish different rules for a future feature.
Completed-game standings remain frozen as permanent history even if ownership of a completed-game collectible later changes through the Lifetime Market. We may correct obvious technical errors, duplicate allocations or fraudulent activity where reasonably necessary to preserve the integrity of the service.
4. Free claims, promotional credits and paid packs
Verified users may receive free claims and promotional credits where offered. The current signup promotion provides new accounts with 50 ordinary full-range number credits after email verification, once per account. Promotional credits do not guarantee any particular number and may be withdrawn or changed for future signups without removing credits already validly granted. Paid packs provide the fixed quantity of ordinary full-range number credits shown at checkout. When redeemed, each credit allocates one random then-available number from the current game's pool, including during its 48-hour final window while claiming remains open.
A purchase does not guarantee Number 1, a low number, a particular rarity, a future sale, profit or any other financial outcome. Numbers are digital in-service collectibles and cannot be redeemed from First To One for cash.
5. Trading and marketplaces
The Marketplace has separate Active Game and Lifetime sections. During an active game and its 48-hour final window, an Active Game card may only be traded for another card from that same game.
After a game has fully completed its 48-hour final window and is archived, its claimed cards may be listed in the Lifetime Market. Lifetime Market trades may exchange cards from different completed games, for example a Game 1 card for a Game 2 card. These transfers change the collectible's current owner but do not rewrite the historical winner, finishing positions or archived game standings.
Player-to-player cash sales and seller payouts are not enabled. If Exact Number Auctions are enabled, they are operated by First To One for specific numbers that are still unclaimed during a game's final 48-hour window; they are not player-listed cash auctions.
6. Exact Number Auctions when enabled
An Exact Number Auction applies to a specific identified number, not a random allocation. The public price starts at A$1.00 and increases in minimum A$1.00 steps unless a different amount is clearly shown before bidding.
You may enter the maximum amount you are willing to pay. First To One then uses proxy bidding: the service automatically increases the public bid only as much as necessary to remain ahead of competing valid maximum bids, up to your maximum. If two users enter the same maximum, the earlier valid maximum retains priority. Your maximum is not displayed publicly.
There is no fee merely to place a bid. Your payment provider may place an authorisation hold for your maximum amount. If your maximum is exceeded, First To One will request release of your authorisation. Bank or card-network release times can vary. If you win, only the final public auction price is intended to be captured after the server-side deadline, even where your authorised maximum was higher.
A number with an active auction reservation is removed from ordinary random claiming while the reservation remains valid. If a first-bid checkout is abandoned or fails before a valid bid is authorised, the reservation may expire and the number may become claimable again. Once the 48-hour deadline passes, new bids are rejected.
If capture of the winning authorisation fails, the transaction may require review and the number may remain unawarded. If a completed auction purchase is later fully refunded and the card is still safely held by the refunded auction purchaser, First To One may temporarily lock trading of that card and offer it to the next eligible prior bidder. A fallback recipient is not automatically charged: they receive a limited-time offer and must actively accept and complete a new payment. If they decline, the offer expires or payment fails, the offer may pass to the next eligible prior bidder. The fallback price is recalculated from the remaining eligible maximum bids using the same proxy-bidding rules.
Refunds, disputes, account changes, transfers or other circumstances can make automatic reassignment unsafe. In those cases the transaction may remain under manual review rather than changing ownership automatically. Completed-game winner and standings history is not rewritten by a later auction refund or fallback transfer.
First To One does not promise that a number will have a resale value, does not redeem cards for cash, and does not guarantee that another user will trade for a card later.
7. What assignment of a number means
A number assigned to your account gives you a personal right to use that digital collectible within First To One under these Terms. It does not give you ownership of our software, database, branding or intellectual property, and it does not create a promise that First To One will buy the number from you.
8. Payments, refunds and disputes
Payments may be handled by third-party payment providers and their terms may also apply. We do not store full card numbers.
Our Refund Policy forms part of these Terms. A refund or payment dispute may require account/transaction review; we will not intentionally remove unrelated credits or historical numbers merely because a payment event is received. Where an eligible auction purchase is fully refunded, the limited fallback process described above may be used without automatically charging any prior bidder. Payment disputes and cases where ownership has already changed may remain under manual review.
Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded, including applicable rights under the Australian Consumer Law.
9. Reports and moderation
Users may report profiles for issues such as spam, harassment, impersonation or inappropriate content. We may review reports, investigate misuse and take proportionate action where reasonably necessary. False or abusive reporting may itself be treated as misuse.
10. Service availability and changes
We may add, remove, pause or change features, prices, limits and availability as the service develops. We do not promise uninterrupted availability. If a service failure affects a paid transaction, we will provide the remedy required by law and our Refund Policy.
11. Intellectual property and user content
First To One, its software, design, logos, text and game systems are owned by or licensed to us. You may not copy or commercially exploit them except as permitted by law.
You retain rights in content you submit, but grant us a non-exclusive licence to host and display it as needed to operate the service.
12. Liability and consumer rights
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded. To the extent permitted by law, we are not responsible for losses caused by your misuse, off-platform dealings or third-party services outside our reasonable control.
13. Suspension, deletion and complaints
You may stop using First To One at any time and may request account deletion through available account controls or support. We may suspend or terminate access for serious or repeated breaches, fraud, security risk or legal/provider requirements. Completed-game history may be retained in anonymised form where needed to preserve the integrity of historical game results.
For complaints, contact one@firsttoone.com.
14. Governing law and changes
These Terms are governed by the laws of Western Australia and applicable Commonwealth laws of Australia, without limiting mandatory consumer rights that apply where you live.
We may update these Terms as the service develops. The current version and effective date will be posted here.
